TradeTools Very Important Tradie (VIT) Terms and Conditions

Thank you for your interest in becoming a member of the TradeTools Very Important Tradie (VIT) Program. Here are a few terms and conditions you should read and be aware of before agreeing to join the TradeTools VIT Program.

1. By Completing the Application Form, you confirm you have reviewed and agreed to these TradeTools VIT Program Terms and Conditions and the TradeTools Group’s Privacy Policy.
2. We reserve the right to change these Terms and Conditions from time to time and you agree that each time you use the TradeTools VIT Program you accept the terms and Conditions as they exist at the time of use. An up to date copy of the Terms and Conditions can be found at www.tradetools.com .
3. Participation in the TradeTools VIT Program is open only to individuals and is offered at the discretion of  TradeTools Pty Ltd and TradeTools Regional Pty Ltd, herein referred to as The TradeTools Group.
4. TradeTools VIT Cards are not debit, credit, or charge cards, are not transferable and remain the property of the TradeTools Group.
5. The TradeTools VIT Card is a loyalty card only and the benefits of the TradeTools VIT Program membership can only be applied upon presentation of the TradeTools VIT Card.
6. The TradeTools VIT Program is only available for use at TradeTools and TradeTools Regional stores within Australia.
7. The TradeTools VIT Program Benefits are
   1. Member only competitions
   2. Special Member only offers
   3. Email bonus offers to one nominated email address
   4. Easy online ordering
   5. Track and trace orders through www.tradetools.com
   6. Email invoices to a nominated email address
   7. Reprint invoices via www.tradetools.com
   8. Transactions for download
8. The TradeTools Group reserves the right to change and amend the access to, benefits of and features of the TradeTools VIT Program at any time and without prior notice. Terms and Conditions will be updated and made available on the TradeTools.com website.
9. From time to time, we may send you offers in conjunction with other programs operated within TradeTools stores.
10. From time to time, we may send you offers from Partners of the TradeTools Group.
11. Each TradeTools VIT Card is valid for one person only and cannot be used by any person other than the Member whose name appears on the TradeTools VIT Program’s original application.
12. The TradeTools Group is not responsible for lost, damaged, or stolen TradeTools VIT cards and a charge may apply for replacement TradeTools VIT Cards. We will let you know if there are any charges prior to the re-issue of a card.
13. Membership and access to the features and benefits of the TradeTools VIT Program may be cancelled or refused to individuals or businesses by the TradeTools Group at its sole discretion, if a Membership is deemed as being fraudulent, linked to a fraudulent Membership and/or if a Member engages in harmful, drunken, violent or threatening behaviour towards the TradeTools Group, any of its employees, any of its customers or any of its partners.
14. You are solely responsible for all government taxes, duties and/or other charges imposed by law in any country with respect to the use of the TradeTools VIT Program, your participation in the TradeTools VIT Program, and any and all associated prizes, giveaways, vouchers or other offers issued or transactions within or resulting from the TradeTools VIT program.
15. Any failure or delay by the TradeTools Group in exercising its rights under these Terms and Conditions does not constitute a waiver of those rights and any waiver by the TradeTools Group must be in writing and signed by an authorised officer of the TradeTools Group.
16. The TradeTools Group reserves the right to terminate the VIT Program at any time by giving you at least 30 days prior notice. Notices will be given via www.tradetools.com. In this case, you will cease to be able to use, access and participate in the TradeTools VIT Program and the TradeTools Group will have no further liabilities to you.
17. Except as provided in any law which cannot lawfully be excluded or modified by agreement, the TradeTools Group does not accept any liability whatsoever, including negligent acts or omissions with respect to:
    1. The breach of any of the terms and conditions or any term implied by law and/or statute by any person other than the TradeTools Group;
    2. Any TradeTools VIT Program benefit, prize, reward, giveaway or offer
    3. Any death or injury or consequential loss or damage arising from the supply of a TradeTools VIT Program benefit, prize, reward, giveaway or offer;
    4. The loss, theft, damage or destruction of a TradeTools VIT Card or any benefit, prize, reward, giveaway or offer;
    5. Any failure, delay, or inability to provide a TradeTools VIT Card or other TradeTools VIT Program benefit, prize, reward, giveaway or offer to you caused by circumstances beyond our control, including, but not limited to employment disruptions or industrial disputes, act of God, flood, weather event, war or civil disturbance; and
    6. Any other liability, loss or damage incurred or suffered by any Member (or any other person) in connection with the TradeTools VIT Program.
18. The TradeTools Group may give you notice:
    1. By advertisement in an Australian newspaper; or
    2. email, sms (to the last known mailing, email or mobile phone number provided), which you are taken to have received upon the sender receiving confirmation the message has been sent; or
    3. By the TradeTools website (www.tradetools.com), which you are taken to have received within 5 days of posting on the website.
19. You must advise us of any change of name, email address, or other details as soon as the change occurs. The TradeTools Group is not responsible for any failure by you to notify the TradeTools Group of the change that may result in the loss of a TradeTools VIT Program feature, benefit, prize, reward, giveaway or offer.
20. Any change to your name, email address or other details can be made by logging in to your profile at www.tradetools.com.
21. These Terms and Conditions will be construed according to and governed by the laws of Queensland and the parties submit to the exclusive jurisdiction of the courts in Queensland.
22. You consent to the TradeTools Group, our partners and from time to time, approved third parties, contacting you by telephone and electronic (email, SMS, social media) methods.
23. Definitions
    1. Application Form means the TradeTools VIT Program application form required to be completed by the individual to become a member. This may include an electronic form, printed form, or application in store when completed by an employee of the TradeTools group and with the express verbal permission of the applicant.
    2. Member means the person who is a member of the TradeTools VIT Program and whose name is listed on the original Application Form.
    3. TradeTools means a TradeTools Pty Ltd or TradeTools Regional Pty Ltd store, online site or social media page or profile.
    4. The TradeTools Group means TradeTools Pty Ltd, TradeTools Regional Pty Ltd, and any of their subsidiaries, partners, employees and authorised representatives.
    5. The TradeTools VIT Program means the loyalty program operated and managed by the TradeTools Group by which a Member may receive TradeTools VIT Program Benefits in accordance with these Terms and Conditions.
    6. TradeTools VIT Program Benefits means facilities, services, products, discounts, offers, activities, events or arrangements offered or made available to Members from time to time.
    7. TradeTools VIT Card means the TradeTools VIT Card and Key Tag provided by the TradeTools Group for use by each Member in relation to the TradeTools VIT Program.
